Payment for the products ordered through the website may be made through a valid credit card, debit card, or other payment method offered through the website. Orders are not binding upon us, until accepted by us. All refunds are in Homme Labs’ sole discretion.
  Homme Labs shall have the right to cancel any orders placed for products listed at the incorrect price, whether or not the order has been confirmed and your credit card or debit card charged. If your credit card or debit card has already been charged for the purchase and your order is canceled, Homme Labs shall issue a credit to your credit card or debit card account in the amount of the charge.

• GUARANTEE AND RETURN POLICIES
  Homme Labs provides a 14-day money-back guarantee policy on all Homme Labs products purchased directly from this website and shipped to the United States. Only one opened product is eligible for return. All others of the same product must be in a factory sealed container to be eligible for a refund. To be eligible for a return, a return request must be submitted within sixty days of the purchased date. A physical return of the item is required to receive a refund. Maximum one return per product per customer/household. Each order requires its own Return Authorization. Multiple orders cannot be combined and returned in one parcel. A refund will be processed once the package has been received. The $9.99 return shipping charges will be deducted from the refund. Homme Labs reserves the right to limit returns if we have reason to suspect misuse of our return policy.

• MANDATORY ARBITRATION AND CLASS ACTION WAIVER
  PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
  Any dispute arising out of these Terms shall be resolved exclusively through final and binding arbitration conducted by the American Arbitration Association (the “AAA”). Arbitration uses a neutral arbitrator instead of a judge or jury, and court review of an arbitration award is very limited. However, an arbitrator can award the same damages and relief on an individual basis that a court can award to an individual; and an arbitrator must also follow the terms of these Terms, as a court would. All issues are for the arbitrator to decide, except that issues relating to arbitrability and the scope or enforceability of this agreement to arbitrate shall be for a court of competent jurisdiction to decide. Arbitration shall take place in Los Angeles, California, unless Homme Labs elects otherwise.
  The arbitrator will decide the substance of all claims in accordance with the laws of the State of California. The arbitrator's award shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules, unless otherwise stated in this Agreement to Arbitrate. If the value of the relief sought is $10,000 or less, at your request, Homme Labs will pay all filing, administration, and arbitrator fees associated with the arbitration. Any request for payment of fees by Homme Labs should be submitted by mail to the AAA along with your demand for arbitration and Homme Labs will make arrangements to pay all necessary fees directly to the AAA. If the value of the relief sought is more than $10,000 and you are able to demonstrate that the costs of accessing arbitration will be prohibitive as compared to the costs of accessing a court for purposes of pursuing litigation on an individual basis, Homme Labs will pay as much of the filing, administration, and arbitrator fees as the arbitrator deems necessary to prevent the costs of accessing arbitration from being prohibitive. In the event the arbitrator determines the claim(s) you assert in the arbitration to be frivolous, you agree to reimburse Homme Labs for all fees associated with the arbitration paid by Homme Labs on your behalf that you otherwise would be obligated to pay under the AAA's rules. If an arbitrator or court decides that any part of this agreement to arbitrate is invalid or unenforceable, the other parts of this agreement to arbitrate shall still apply.
  You can choose to reject this agreement to arbitrate by mailing us a written opt-out notice (“Opt-Out Notice”). The Opt-Out Notice must be postmarked no later than thirty days after the date you accept these Terms for the first time. You must complete the Opt-Out Notice form by providing the information called for in the form, including your name, address (including street number and address, city, state, and zip code), phone number, and the email address used to log in to the Homme Labs account to which the opt-out applies. You must sign the Opt-Out Notice for it to be effective. This procedure is the only way you can opt out of the agreement to arbitrate. If you opt out of the agreement to arbitrate, all other parts of these Terms will continue to apply. Opting out of this agreement to arbitrate has no effect on any previous, other, or future arbitration agreements that you may have with us.
  Class Action Waiver. YOU AND HOMME LABS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. This means that you and Homme Labs expressly waive any rights to file a class action or seek relief on a class basis.
  Survival. This Mandatory Arbitration and Class Action Waiver section shall survive any termination of your use of the website.

• NOTICES
  Except as explicitly stated otherwise, any notices shall be given by postal mail to Canyon Path., 500 S SEPULVEDA BLVD STE 100A LOS ANGELES, CA 90049 (in the case of Homme Labs) or to the address you provide to Homme Labs during the purchase process (in your case). Notice shall be deemed given three (3) days after the date of mailing.

  These Terms, including the Privacy Policy, constitute the whole legal agreement between you and Homme Labs and govern your use of the website, services and any transactions you may have with Homme Labs through the website and completely replaces and supersedes any prior agreements or understanding, arrangements, undertaking or proposal, written or oral, between you and Homme Labs  in relation to such matters. Those who choose to access the website from other locations do so on their own volition and are responsible for compliance with applicable laws.
  This Agreement may not be otherwise amended except in writing signed by you and Canyon Path. This Agreement is subject to and governed by the laws of the State of California, with the exception of its conflict of laws provisions. Any waiver or forbearance by Homme Labs of any breach (by Customer) of any provision of this Agreement shall not be construed as a waiver of any subsequent breach by Customer. This Agreement shall be binding upon the parties and their executors, administrators, successors, and assigns. If any provision of this Agreement is held illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability will not affect any other provision hereof. Such provision and the remainder of this Agreement and schedules shall, in such circumstances, be deemed modified to the extent necessary to render the remaining provisions enforceable.
